In March, Governor Jay Inslee officially approved the legalization of in-person and mobile sports betting in Washington. This move made Washington the first state in 2020 to become part of the legalized sports wagering community in the United States.
Although the bill was considered a major win for the state’s tribal casinos, the process was lengthy. Throughout the year, there was minimal advancement on new sports betting compacts due to the government’s prioritization of urgent pandemic-related issues.
2021: Tribes Clash With Gaming CEO
The turning of the calendar brought some advancements in Washington’s efforts to establish legal sports betting, but it was not without obstacles.
Eric Persson, CEO of Maverick Gaming, urged the state to broaden its sports betting legislation to encompass card rooms and racetracks licensed in Washington, allowing for widespread mobile sports wagering. The proposed bill SB5212 included a 10 percent tax on gaming revenue and a $100,000 license fee.
The tribes were strongly opposed. Rebecca George, Executive Director of the Washington Indian Gaming Association, not only disputed Maverick’s claim that card rooms could generate $50 million in tax revenue from sports betting each year, but also argued that allowing mobile sports betting off tribal lands would restrict the amount of money the tribes could contribute to their less affluent communities.
Despite no changes to the law, Inslee signed 15 tribal sports betting compacts in July 2021. Two months later, the Snoqualmie Tribe became the first in Washington to accept retail sports bets, followed by becoming the first tribe to offer mobile betting before the end of the year.
2022: Maverick Files Lawsuit Against State
After several more Washington tribes introduced retail sports betting, Maverick filed a lawsuit alleging that the state had acted illegally by granting exclusive sports wagering rights to the tribes.
The lawsuit extended into 2023 before being dismissed, but further legal hurdles to the tribe’s monopoly are expected to persist. In the meantime, tribal casinos have been increasing their sports betting offerings, partnering with DraftKings, FanDuel, and Caesars in early 2022.
