1940s: Legal Sports Betting is Born

Ten years after Governor Fred Balzar of Nevada signed Bill AB 98 into law, which legalized gambling in the state, infamous mobster Bugsy Siegel became the first person to offer race disseminating services in 1941. 1970s: Welcome Tax Relief for Underscoregs

2000s: Nevada Rebounds From 9/11

After the September 11, 2001 terror attacks, Nevada’s rapid growth came to a sudden stop. Tourist activity plummeted, leading to widespread job cuts and closures. It wasn’t until 2005 that the state finally regained its pre-9/11 levels of economic stability.

Despite a significant slowdown in the earlier part of the decade, Las Vegas reclaimed its position as one of the top tourist destinations in the world once people began to feel comfortable traveling again. Annual revenue exceeded $10 billion in 2004, leading to the development of new casino-hotel combinations such as Wynn Las Vegas, Encore Las Vegas, and The Palazzo.

2011-13: NJ legislation passes; leagues fight back

In November 2011, a sports-betting referendum in New Jersey was widely supported, paving the way for the Sports Wagering Act of 2012. This legislation permitted betting on specific professional and collegiate sports events at casinos and racetracks.

Unfortunately, it proved to be more complicated than anticipated. The major sports organizations in North America (NFL, MLB, NHL, and the NCAA) opposed the legislation, contending that New Jersey’s bill was in violation of PASPA. Despite New Jersey’s appeal, it was ultimately unsuccessful.

During the early 2010s, Las Vegas faced its most difficult period in decades. A severe recession led to a decrease in tourism and spending, causing many layoffs and significant delays in casino construction, expansion, and refurbishment projects.

2014-17: NJ Wins Audience With SCOTUS

In October 2014, New Jersey Governor Chris Christie signed legislation allowing casinos and racetracks to offer sports betting by repealing the state law prohibiting the practice. This was Christie’s latest attempt to legalize sports betting after his previous efforts had been unsuccessful.

The leagues quickly reacted, with the NBA also joining in this time. They argued that Christie’s actions were an attempt to circumvent PASPA. Following the granting of an injunction, the U.S. Third District Court of Appeals affirmed the decision with a 2-1 vote in the summer of 2015.

Despite their frustration, New Jersey lawmakers remained determined to bring their case to the highest court in the United States. However, before they could do so, the Supreme Court sought the opinion of U.S. Solicitor General Jeffrey Wall, who recommended in May 2017 that SCOTUS not proceed with a hearing.

A little over a month later, the Supreme Court shocked many by agreeing to hear New Jersey’s petition. Although New Jersey had been largely on its own in pushing for this opportunity, 20 states and the American Gaming Association filed amicus briefs in support of legalizing sports betting.

2018: PASPA Vanishes, Sports Betting Launches

After a five-month wait, the Supreme Court ruled with a 6-3 majority that the federal ban on sports betting is unconstitutional. This decision sparked a flurry of activity nationwide, with New Jersey positioned to lead the way in the new era of sports wagering in the United States.

Governor Phil Murphy signed Assembly Bill 4111 the next month, paving the way for legal sports betting at casinos and racetracks. Shortly after, DraftKings Underscoreg made history as the first online sportsbook operator to launch in New Jersey and the first outside of Nevada.

In the first year after PASPA was overturned, several states joined New Jersey in legalizing sports betting. Delaware was the first state outside of Nevada to offer legal sports betting through a retail location. Additionally, New Mexico, Mississippi, Pennsylvania, Rhode Island, and West Virginia all began accepting their first sports wagers in 2018.

2019: NJ Dominates Sports Betting Landscape

Due to extensive preparation, New Jersey outpaced the rest of the country in launching legal sports betting, demonstrating its effectiveness. Serving as a model for other states, New Jersey experienced immediate success, achieving over $300 million in handle for five consecutive months at the beginning of 2019.

Following that, the focus shifted to the NFL and NCAA football seasons, resulting in New Jersey experiencing record-breaking numbers with a handle of almost $2.6 billion from September 2019 to January 2020 and a total of $4.6 billion for the calendar year.

In 2019, several new states, including Arkansas, Indiana, Iowa, New Hampshire, and Oregon, joined the industry by allowing legal sports betting for the first time.

2020: COVID-19 Halts Momentum

As more states passed laws to break monthly records, the COVID-19 pandemic disrupted the entire North American sports schedule. 2021: Records Fall Everywhere

In 2021, the U.S. sports betting industry experienced unprecedented growth, with New Jersey leading the way. Following a $959-million handle in January, the state consistently broke monthly records after the NFL season ended. New Jersey achieved a major milestone by surpassing billion-dollar handles in each of the final four months of the year, ultimately reaching a total handle of $10.93 billion for the year.

The surge in legal sports betting was not exclusive to New Jersey, as every state that allowed it saw record numbers in 2021. More states, including Arizona, Connecticut, Nebraska, North Carolina, South Dakota, Virginia, Wisconsin, and Wyoming, joined the U.S. betting scene by accepting legal wagers for the first time.

2022: No Stopping New York

In 2022, none of the top four states in the U.S. with the largest populations had legalized sports betting. However, this changed in January when New York, the fourth most populous state, joined the group and quickly began to see significant financial gains from legal sports wagering.
